    Section 504 of the Federal Rehabilitation Act of 1973 states:

    No otherwise qualified individual with a disability in the United States [as defined] shall solely by reason of her or his disability, be excluded from participation in, denied the benefits of, or subjected to discrimination under any program or activity receiving Federal financial assistance.

    ÃÛÌÒÖ±²¥ implements and maintains regulations to identify and evaluate students with disabilities in schools and programs operated by the District, to ensure that a free, appropriate public education (FAPE) is provided to each qualified student, and to provide safeguards for the rights of the students and their parents/guardians.

    504 Regulation 34 CFT 104.3(j-l) defines:

       “a person with a disability as any person who has a physical or mental impairment that substantially limits one or more major life activities, has a record of such impairment, or is regarded as having such impairment.”
